i-SENS Inc. (“we”, “our” or “us”) respects your privacy. This Privacy Policy applies to the personal information we collect through our online and mobile websites, including www.i-sens.com (collectively the “Service”) and through our “point of care” devices (this is medical testing at or near where you receive your care, carried out by specially trained healthcare professionals) (“POC Devices”) and our blood glucose monitoring devices (“BGM Devices”). Other platforms operated by us, such as our other devices (such as the CGM devices), programs, or mobile applications, will be subject to separate privacy policies.
In this Privacy Policy, we describe the personal information we process through the Service, POC Devices and BGM Devices, how we may use the personal information, how long we may keep the personal information, with whom we may share the personal information, the choices available to you regarding our use of the personal information and how you may exercise your rights, including the right to object to some of the processing which we carry out. We also describe the measures we take to safeguard the personal information and inform you how to contact us about our privacy practices

1. Information We Collect and How We Collect the Information
We collect your personal information when you interact with us and our Service. Personal information consists of all information related to an identified or identifiable natural person. This includes:

WE DO NOT COLLECT THE PERSONAL INFORMATION FROM USERS WHO ARE BELOW THE AGE OF 16 YEARS. IN CASE YOU ARE BELOW 16, DO NOT PROVIDE US WITH YOUR PERSONAL INFORMATION. If you believe there is any chance that we collect or process personal information from a user below the age of 16 years, please contact us at DPO.i-Sens@twobirds.com.
Sometimes, we receive information about you from third parties. In particular we receive patient ID from POC Devices (“POC Device Information”) and from BGM Devices (“BGM Information”) from our local distributors and your healthcare providers.

There are instances where we have a legitimate interest to use your data. Our legitimate interest will vary depending on what we are using your data for, and we explain above what the interest is and how it relates to the processing operations that we are carrying out. We will retain personal data for as long as is necessary to carry out the purposes the personal data was collected for or for the period prescribed by applicable laws, whichever is longer. In considering how long to retain your personal data the following are considered:

- The volume and sensitivity of the personal data;
- The purposes for processing your personal data;
- Whether we need to keep a record of the relationship we have or had with you;
– applicable legal or regulatory requirements, as required under a contract to which you are a party, including to keep a record for possible future claims, or with regard to our industry standards or guidelines, or statutory obligations (e.g. tax laws); or
– only for as long as is necessary for the purpose for which it was collected, is processed, or longer if required under any contract to which you are a party, by applicable law, or, in anonymized form, for statistical purposes, subject to appropriate safeguards; and. - If circumstances have changed such that the purposes for which the personal data was collected can be achieved by other means.
When the retention of your personal data is no longer required, we will delete or anonymise the data.
5. Your Rights
You have the following rights:
- The right to receive a copy of your personal data (the right of access)
- The right to request us to correct any inaccurate or incomplete information (right to rectification)
- The right to request us to halt the processing of your personal data in certain circumstances (the right to restrict processing)
- The right to object to us processing your personal data on the basis of our legitimate interests (or those of a third party), including processing for direct marketing purposes or profiling for purposes of direct marketing, or where we are performing a task in the public interest – your objection will be upheld, and we will cease processing your personal data, unless the processing is based on compelling legitimate grounds or is needed for the exercise or defence of legal claims that may be brought by or against us (right to object)
- the right to ask us to delete your personal data in certain circumstances (the right to erasure) or
- The right to request we transmit personal data that you have provided to us, to a third party without hindrance, or to give you a copy of it so that you can transmit it to a third party, where technically feasible (right to portability).
These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep.

Wherever we rely on your consent to the processing of your data, you have the right to withdraw this consent effect any time. The legality of data processing prior to your withdrawal remains unchanged. We may however have other legal grounds for processing your data for other purposes, such as those set out above. If you have unresolved concerns, you have the right to complain to a data protection authority in the country that you reside in or, the country of your place of work or the country where the alleged infringement took place. 6. How We Protect Personal Information
We take protection of your information seriously and have put in place appropriate physical and technical measures to safeguard the information we collect in connection with the Service. However, please note that although we take reasonable steps to protect your information, no website, internet transmission, computer system, or wireless connection is completely secure.

Personal information we collect from you may be transferred to and stored at other countries outside of the UK and the EEA. Such countries include, without limitation, the Republic of Korea and the United States of America. Where these locations do not provide an adequate level of data protection, we will ensure appropriate safeguards are in place to protect the transfer of your personal data to these countries. These safeguards include:
- the use of EU Standard Contractual Clauses and the UK International Data Transfer Agreement or Addendum;
- the US Data Privacy Framework for certain transfers to the United States; and

This Privacy Policy may be updated to reflect changes in our personal information practices with respect to processing for the Service, POC Devices or BGM Devices or changes in the applicable law. We will post a notice on our website to notify you in advance of material changes to our Privacy Policy and indicate at the top of the notice when it was most recently updated.
